Terms of Service

CycleArena is operated by PinkertonDigital LLC (“CycleArena,” “we,” “us,” or “our”). By accessing or using CycleArena, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old to use CycleArena. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these terms for you. You may not use the service where doing so is prohibited by law.

CycleArena is live and playable in Open Beta. Features, game balance, availability, rules, and career systems may change as development continues toward version 1.0. Interruptions, defects, and data corrections may occur.

Beta XP, levels, challenges, and career statistics may reset before version 1.0. Our current Beta policy preserves accounts, Credits, cosmetics, purchases, entitlements, and permanent reward claims through a career reset. This does not prevent corrections for fraud, errors, refunds, reversals, chargebacks, or violations of these terms.

• You may play some parts of CycleArena as a guest. Guest progress is temporary and may expire unless it is successfully transferred to a permanent account.
• You are responsible for accurate registration information, your account credentials, and activity under your account.
• Usernames, profile content, and account activity must comply with these terms. We may change or remove names that impersonate others, violate rights, or disrupt the community.
• Do not sell, share, transfer, or provide unauthorized access to an account.

The following conduct is prohibited:

• Do not cheat, automate play, exploit defects, manipulate matchmaking or progression, or use unauthorized software to gain an advantage.
• Do not harass, threaten, abuse, discriminate against, or impersonate another person.
• Do not disrupt servers, evade security or moderation controls, probe for vulnerabilities, or access non-public systems without permission.
• Do not upload malicious, unlawful, infringing, deceptive, or privacy-invasive material.
• Do not use CycleArena for commercial exploitation or reverse engineer it except to the limited extent applicable law expressly permits.

Report suspected exploits rather than using or distributing them. We may investigate gameplay and account records to protect players and the service.

Credits, cosmetics, badges, and other virtual items are licensed for use within CycleArena. They are not legal tender, have no cash value, and cannot be transferred or redeemed for money unless applicable law requires otherwise. Prices, taxes, and included items are shown before payment.

Payments are processed by Stripe. Refund rights required by law still apply. Product-specific terms may add rules to a purchase. The Founding Pilot Terms govern that program and control if they conflict with these general terms on a Founding Pilot-specific issue.

You retain rights you have in content you submit, such as chat, feedback, avatars, profile material, and highlight labels. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, format, and moderate that content only as reasonably needed to operate, secure, promote, and improve CycleArena.

You must have the rights needed to submit content. Public usernames, profiles, chat, and shared highlights may be seen or recorded by other players. We may remove content or restrict features when reasonably necessary for safety, legal compliance, or enforcement. Feedback and suggestions may be used without compensation or an obligation to implement them.

CycleArena, including its software, game systems, art, audio, brands, and other content supplied by us, is owned by or licensed to PinkertonDigital LLC and is protected by intellectual-property laws. These terms grant only a limited, personal, revocable, non-transferable right to use the service as offered.

CycleArena uses third-party providers for functions such as authentication, hosting, payments, analytics, bot protection, advertising, and storage. Their services may be governed by their own terms and privacy notices. We are not responsible for unrelated third-party websites reached through external links.

We may warn, restrict, suspend, or terminate access when we reasonably believe these terms were violated, the service or another person is at risk, or the law requires it. We may modify, suspend, or discontinue features or the service. Where practical, we will avoid unnecessary harm to valid paid entitlements, but payment reversals, fraud, legal requirements, and material violations may affect access or grants.

To the maximum extent permitted by law, CycleArena is provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, secure, or permanently available service, or that Open Beta features will remain unchanged. Nothing in these terms excludes warranties or consumer rights that cannot legally be excluded.

To the maximum extent permitted by law, PinkertonDigital LLC and its affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from CycleArena. Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid us for the service during the 12 months before the claim or US $100. These limits do not apply where applicable law prohibits them.

We may update these terms as CycleArena develops. We will post the revised effective date and provide additional notice when required by law. Continuing to use the service after updated terms take effect means you accept them.
